Declaratory judgment of birth
Definition
If a birth is not registered within the statutory time limit, the registrar cannot rectify the situation themselves and is obliged to refer the matter to the public prosecutor. They may only record the birth in the civil status registers on the basis of a declaratory judgment of birth.
A declaratory judgment of birth records the birth and orders its entry in the registers of the place of birth. The entry of this declaratory judgment of birth in the civil status registers serves as a birth certificate.
Declaratory judgments of birth are included in all INSEE publications on births.
