Définition

Protection is triggered by the date of filing. There are three forms of protection of industrial property rights :

  • national : this is an application for protection covering French territory. The procedure for issuance or registration is carried out by the National Institute of Industrial Property (INPI) ;
  • European : application for protection under the European procedure for the issuance of patents (Munich Convention) can be made through the European Patents Office. Since 1996, application for the protection of brands in the countries of the European Union can be made through the Office of Harmonisation for the Internal Market (OHIM), as is the case for designs and models, since 2003 ;
  • international : application for protection is possible by virtue of the Patent Cooperation Treaty (PCT), of the Madrid system for the international registration of brands and the system of The Hague for designs and models. The international procedure is managed by the World Intellectual Property Organisation (WIPO).
