Définition

The quarterly rent reference index- 2005 law (IRL 2005 law the text of which was abrogated in 2008) created by Law n°2005-841 of 26 July 2005 on the development of personal services, was calculated as the weighted sum of representative indices of consumer price trends, of the cost of maintenance and improvement work borne by landlords, and of the cost-of-construction index. To calculate the Rent reference index- 2005 Law, the mean of the consumer price index over 12 consecutive months was used. The last month corresponded to the last month of the quarter for which the Rent reference index- 2005 Law was being calculated. This mean (mIPCL) was expressed in relation to the reference 100 at Q2 2004.

The representative index of consumer price trends was the INSEE consumer price index excluding tobacco and excluding rent (IPCL).

The representative index of trends in the cost of the maintenance and improvement work borne by landlords was the housing maintenance and improvement index (IPEA) calculated by the Statistics Office of the Ministry for Infrastructure. This index was calculated inclusive of VAT and it was the mean of the index over four consecutive quarters that was used, with the last quarter corresponding to the last month of the quarter for which the Rent reference index- 2005 Law was being calculated. This mean (mIPEA) was expressed in relation to the reference 100 at Q2 2004.

The representative index for construction costs was the cost-of-construction index (ICC) published by INSEE. For the calculation of the IRL- 2005 law, the mean of the index over 4 quarters was used, with the last quarter corresponding to the quarter the IRL was calculated. This mean (mICC) was expressed in relation to the reference 100 at Q2 2004.

Rent reference index- 2005 law = 60% mIPCL + 20% mIPEA + 20% mICC.

Remarque

The rent reference index- law of 2005 came into force on 1st January 2006 (Article 163 of the Finance Law for 2006). In this definition, the rent reference index has no longer been in force since 10 February 2008. Law n° 2008-111 of 8 February 2008 (entry into force on 10 February 2008) introduced a new rent reference index.
