Open custody (justice)

Definition

Convicted persons serving their sentence in open custody are subject to various obligations under the control of the judge responsible for the execution of sentences, assisted by a prison service for integration and probation. The following main items are distinguished :

- convicted persons sentenced to a suspended prison term with probation ;
- persons sentenced to community service and who perform unpaid work for between 40 and 240 hours for a public authority, a public establishment or an association ;
- conditionally released prisoners who, owing to their serious guarantees of social re-adaptation, are released early on the condition that they submit to the control of the judge responsible for the execution of sentences and they comply with various obligations for a period at least equal to the remainder of their sentence.
