Discharge of penalty

Definition

The defendant may be granted a discharge of penalty, for a misdemeanour or an offence, if it appears that he has been rehabilitated and the damage has been repaired and what the disorder resulting from the breach stopped. If the stipulated conditions are in the process of being fulfilled, the announcement of the sentence may be postponed, so as to enable such exemptions, where applicable (art. 132-58 et 132-59 of Penal Code).
